These are the terms for buying from Cursed Clay Co, run by Charlotte [SURNAME], based in Worcestershire, United Kingdom. They are written in plain English on purpose. Buying a creature from this site means you agree to them. Nothing here reduces your legal rights as a UK consumer.

The creatures
Every creature is sculpted, painted and sealed by hand, one at a time. Each one is genuinely one of a kind: when it is adopted, it is gone, and no copy will ever be made. The photos on each creature’s page show the exact creature you will receive. Colours can vary slightly between screens, and small quirks of the hand-making process are part of the character, not defects.

Creatures are decorative collectibles, not toys. They are not suitable for young children or pets, and they contain small parts that are exactly the wrong size for both.

Ordering and payment
Prices are shown in pounds sterling and include everything except any delivery cost shown at checkout (UK delivery is currently free). Payment is taken at checkout through our secure payment processor. Your order is confirmed by email once payment has gone through.
Because every creature is one of a kind, it is possible in rare cases for two people to try to adopt the same creature at almost the same moment. The first completed checkout wins. If a payment is taken for a creature that has already been adopted, we will tell you straight away and refund you in full immediately.

Delivery
Creatures are carefully wrapped and posted from Worcestershire within 14 working days of adoption. UK delivery is free. Once a creature has been delivered to the address you gave us, responsibility for it passes to you.

Changing your mind
Under the Consumer Contracts Regulations you have the right to cancel your order for a ready-made creature up to 14 days after the day you receive it, for any reason. Tell us by email within that window, then return the creature within 14 days of telling us. It needs to come back in the condition it arrived in, and return postage is your responsibility. We recommend using the original packaging and a tracked service, since the creature remains yours until it arrives safely back with us. We will refund you in full within 14 days of receiving it back.
Commissioned creatures are different. Because a commission is made to your specification, the legal right to cancel for a change of mind ends once work on your creature has begun. This does not affect your rights if something is actually wrong with it.

Damaged or faulty creatures
If your creature arrives damaged or develops a genuine fault, email us within 30 days with a photo and we will make it right. Because each creature is one of a kind, an identical replacement is impossible, so the remedy will be a repair where practical or a full refund. Your rights under the Consumer Rights Act 2015 are not affected by anything in these terms.

Commissions
Custom creatures are agreed individually: you tell us what horror you have in mind, we confirm the details, price and timescale by email before any work or payment happens. The email thread confirming your commission forms part of these terms for that order.

Ownership of designs
The creatures you buy are yours. The designs, the name Cursed Clay Co, and all photography and text on this site remain ours, and cannot be reproduced commercially without permission.

The boring but necessary bit
We are responsible for foreseeable loss caused by us breaking these terms, and nothing here limits liability where the law does not allow it. Our total liability for any order is limited to the amount you paid for it. These terms are governed by the law of England and Wales.
